'Education and the Law’ offers principals, school leaders, and trustees ongoing access to reputable and informed legal advice and guidance. Created in partnership with two of New Zealand’s leading education lawyers – Gretchen Stone and Fi McMillen, 'Education and the Law' helps ensure that school leaders and trustees are well positioned to manage common school-related scenarios in ways that reduce the potential for litigation and conflict.

This series of online, on-demand modules covers key aspects of common law-related scnearios faced by school leaders and governors when dealing with staff, parents, and students.

Learning outcomes

Navigate relationships, rights and tikanga when dealing with key parties, apply statutory requirements and regulations, and ensure appropriate policies are in place. In particular, the programme will help you:

  1. With Staff: understand and apply statutory requirements, policies for staff discipline and competency, minimise and proactively address potential harm to staff.
  2. With Parents: determine a suitable approach, apply policies and communication protocols, including requests for information and reporting.
  3. With Students: follow regulations for suspensions, stand-downs, exclusions and/or expulsions, and respond to legal challenges.
  4. With your Board: understand governance and management responsibilities, establish positive relationships and processes for issue resolution.

These outcomes provide a comprehensive learning framework for effectively managing various aspects of school administration. They are designed to be concise yet cover all the essential aspects of each unit.

Gretchen Stone – Partner, Harrison Stone

Harrison Stone has acted as the legal advisors for SPANZ for almost 20 years, and in that time, they have developed significant expertise and practical experience in the issues that schools and school leaders face in New Zealand. Gretchen, a partner in Harrison Stone and an employment law specialist, has vast experience in providing a broad range of education specific advice.

Fiona McMillen – Special Counsel, Anderson Lloyd

Fi is the legal advisor to the New Zealand Principals’ Federation 'Principals Advice and Support Scheme'. She is Special Counsel in the Employment Team of Anderson Lloyd, specialising in Employment and Education Law. Prior to becoming a lawyer, Fi worked as a primary school teacher providing a unique understanding on legal issues affecting schools.

What we will cover
Structure

The resource covers four learning modules. Each module includes a 12-15 minute video with supporting readings for each of the topics. The time estimated to complete each module is 30 minutes.
